RISK OF LOSS

All items purchased from Maker's Pet are made pursuant to a shipment contract. This basically means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

SAFETY

Maker's Pet sells technology kits, including DIY, robotic products and accessories that may require the user to have certain skills in order to be assembled, operated and/or modified. These user skills may include understanding of and experience in electronics, software, mechanical, optical engineering as well as safety.

Your safety is your own responsibility, including proper use of equipment and safety gear, and determining whether you have adequate skill and experience. Power tools, electricity, and other resources used for these projects are dangerous, unless used properly and with adequate precautions, including safety gear. Some illustrative photos do not depict safety precautions or equipment, in order to show the project steps more clearly.

Projects and kits sold by Maker's Pet are not intended for use by children. Responsible adult supervision is required if a minor does end up using a Maker's Pet product.

Use of the instructions, kits, projects and suggestions on makerspet.com is at your own risk. Maker's Pet disclaims all responsibility for any resulting damage, injury, or expense. It is your responsibility to make sure that your activities comply with applicable laws, including copyright. Always check the webpage associated with each project for any recent corrections before you get started.

If you feel uncomfortable with assembling any project or kit, simply contact us to return it for a refund.

Maker's Pet is not responsible for your product function or certification if you choose to use our products in your design.

ACCURACY OF INFORMATION

We attempt to ensure that information on makerspet.com is complete, accurate and current. However, Maker's Pet does not warrant that product descriptions, design files, instructions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by Maker's Pet itself is not as described, your sole remedy is to return it in unused condition.

Due to the complexity, the number of products we have and the associated documentation, hardware and/or software being updated by ourselves and/or our third-party vendors and/or independent providers whos software is used in Maker's Pet products (including open source), it may not always be feasible to us to maintain documentation for every product up-to-date. We cannot, therefore, guarantee that all information on this site is complete or current.

EXPORT COMPLIANCE

Customer agrees to comply with these laws and regulations and certifies that it will not use, sell, resell, export, re-export, import, dispose of, disclose or otherwise deal with the products or services delivered under this Agreement, directly or indirectly, to any country, destination or party without first obtaining any required export license or other governmental approval, and completing such formalities as may be required. Customer further agrees to not do anything which would cause Maker's Pet to be in breach of the export control and trade sanctions laws and regulations.

INDEMNIFICATION

Customer shall protect, defend, indemnify and hold harmless Maker's Pet, its shareholders, directors, officers, employees and agents from any fines, damages, costs, losses, liabilities, fees, penalties, claims and expenses (including legal fees and expenses) incurred by Maker's Pet as a result of the failure of the Customer or its agents, officers, directors or employees to comply with this Section.

Third-Party Links

We may link to sites operated by third parties in order to provide you with additional information related to Maker's Pet products and related technologies. However, we have no control over these linked sites. If you use these links, you will leave makerspet.com, and we are not responsible for operation of or any content, materials or other information located on the linked website. Your use of the linked websites is entirely at your own risk.

LIMITED WARRANTY

We warrant Maker's Pet manufactured products will be free from manufacturing defects for a period of thirty (30) days following the date of delivery to you. We will replace, repair or credit you for any confirmed defective product at our option. Please contact support at makerspet.com with any issues.

Products that are not manufactured by Maker's Pet may, or may not, be covered by original manufacturer warranty and passed through to you. Please contact support to confirm warranty period prior to purchase.

Warranty will not apply if Product fails or is damaged after delivery to you due to accident, abuse or misuse.

TO THE MAXIMUM EXTENT ALLOWED UNDER APPLICABLE LAW, EXCEPT FOR THE EXPRESS LIMITED WARRANTIES SET FORTH ABOVE, PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” AND Maker's Pet AND ITS SUPPLIERS MAKE NO WARRANTIES UNDER THIS AGREEMENT, EXPRESS, IMPLIED, OR STATUTORY, BY OPERATION OF LAW OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR ANY IMPLIED WARRANTIES ARISING OUT OF COURSE OF PERFORMANCE, COURSE OF DEALING OR USAGE OF TRADE UNDER OR IN CONNECTION WITH THE PRODUCTS.

Maker's Pet DOES NOT WARRANT THAT THE PRODUCTS AND CONTENT WILL OPERATE ERROR-FREE, UNINTERRUPTED, OR THAT THEY WILL BE SECURE OR VIRUS-FREE. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY Maker's Pet, ITS AGENTS OR OTHER REPRESENTATIVES OR EMPLOYEES SHALL IN ANY WAY INCREASE THE SCOPE OF Maker's Pet’s WARRANTIES UNDER THIS AGREEMENT. WITHOUT LIMITING THE GENERALITY OF THE FORGOING, Maker's Pet AND ITS SUPPLIERS DO NOT MAKE, AND EXPRESSLY DISCLAIM, ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, RELATED TO ANY THIRD PARTY INTELLECTUAL PROPERTY, TECHNOLOGY OR INFORMATION PROVIDED AS PART OF THE PRODUCT OR DOCUMENTATION.

NO LIABILITY

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY THIS SITE IS PROVIDED BY Maker's Pet ON AN "AS IS" AND "AS AVAILABLE" BASIS. APPLICABLE LAW

By visiting Maker's Pet, you agree that the laws of the state of DEFINE_STATE, DEFINE_COUNTRY, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Maker's Pet or its associates.

DISPUTES

Any dispute relating in any way to your visit to Maker's Pet or to products you purchase through Maker's Pet shall be submitted to confidential arbitration in DEFINE_STATE, DEFINE_COUNTRY, except that, to the extent you have in any manner violated or threatened to violate Maker's Pets intellectual property rights, Maker's Pet may seek injunctive or other appropriate relief in any state or federal court in the state of DEFINE_STATE, DEFINE_COUNTRY, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrators award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
